The interior was festively decorated, with thirty to forty tables arranged around a wooden dance floor, each set with cutlery, glasses, and streamers. Prior to midnight, there were no streamers on the dance floor.

The Incident

As the midnight countdown began, the venue dimmed the lights, and patrons threw streamers onto the dance floor. After the celebration, Tsiaras remained on the dance floor, dancing with a friend. It was during this time that she fell and injured herself. At the time of her fall, Tsiaras was wearing high-heeled shoes and there was no evidence of liquid spillage or food on the dance floor.

The Claim

Tsiaras accused SPI Management of negligence, alleging they failed to ensure her safety. The particulars of negligence included failure to prevent the presence of the streamers on the dance floor from causing harm, failure to provide adequate training to staff to keep the floor free of tripping hazards, and failure to warn patrons of the tripping/slipping hazard represented by the streamers.

The Defendant’s Position

SPI Management did not admit to the claims made by Tsiaras, including the presence of numerous streamers and party poppers on the dance floor at the time of the incident, and denied that Tsiaras’s injuries were caused by its negligence.

Court’s Decision

The court found in favour of the defendant, SPI Management Pty Ltd, dismissing Tsiaras’s claims.
